Duval, Jr awarded over $719,000 to four different sets of plaintiffs who alleged that the MRGO, a 76-mile manmade waterway that allowed vessels to quickly get from the Gulf of Mexico to the Industrial Canal, exasperated the conditions that led to flooding in the St. Bernard area.

The ruling could set a precedent for over 400,000 other residents who have filed damage claims against the government -- and that, says Dr. Ivor Van Heerden, is a huge win for the city of New Orleans.

“But I think this is a huge win, not only for the plaintiffs but also the people of New Orleans, and that finally we've got some acknowledgement of the [Army Corps of Engineers] fault and the failure of the levee system,” said Van Heerden, who provided data and consulted for the plaintiffs.

http://www.wwltv.com/home/Federal-court--704216...

In landmark ruling, judge says Corps' negligence caused Katrina flooding
by Chad Bower / Eyewitness News

Posted on November 18, 2009 at 7:48 PM

Updated today at 9:58 PM

NEW ORLEANS — A federal court judge has ruled in favor of several plaintiffs in a case deciding whether the Mississippi River Gulf Coast Outlet is in part to blame for the flooding that followed Hurricane Katrina.

Judge Stanwood R. His justification is that he fears what kind of bill would result if he did vote no:

If opponents prevent consideration of the revised Senate Finance Committee legislation, Nelson said, Democratic supporters “most likely” would turn to the budget reconciliation process to consider health care.

That maneuver would reduce the number of votes required from 60 to a simple majority of 51, he said. In effect, that would remove any need to respond to the concerns of centrist Democrats or independent Sen. Joe Lieberman of Connecticut.

…
“If the three of us voted against the cloture motion,” Nelson said, “we don’t stop health care reform.”

Instead, the Obama administration would decide whether to try to negotiate an amended bill, he said, or the Senate leadership could “go right to reconciliation.”

http://fdlaction.firedoglake.com/2009/11/18/ben...

Ben Nelson Unlikely To Block Motion To Proceed, Fears Reconciliation
By: Jon Walker Wednesday November 18, 2009 12:52 pm

Ben Nelson is unlikely to block allowing debate to proceed on health care reform.
