I did tell the man to keep talking. I'm just gonna watch this unravel before their eyes. Sotomayor is gonna be just fine. Latinos are gonna band together even more across political lines, and it's gonna be against the Republican-led racial mania. Which is bad for, you know, Republicans, come election time. So, I'm just here for moral support for my fellow non-White Americans during this time of “Nigga Moment-hood”. They'll come out stronger for this, and Republicans will come out weaker for this. It's win/win in my eyes.

BTW, the Disability Community is watching this with eyes wiiiiiiiide open. Sotomayor is kind of a shero in our neck of the words. She was the presiding judge in the Bartlett Case. After ADA passed in 1990, there was still a lot of cleaning up to do, as ADA is so incredibly vague. Judge Sotomayor ruled in favor of someone with a Reading-specific Learning Disability having extra time to take the Bar Exam. It set a precedent for people with Learning Disabilities to get accommodations. As soon as Sotomayor was nominated my listerves and blogs lighted up in celebration. This in addition to the fact that she has Diabetes is the reason why we take a kinship to her as well. So Republicans are not just kicking Latinos, they are slapping the Disability population in the face when they attack her.

But like I said, please keep talking Rush, et. al. You are who we think you are, we just want other people to know it as well as we do.

The thing I love about this man is that once he makes a decision, he stands. STANDS. He walks right up to it and deals with all comers. Plus, he's thinking 4, 5, 6 steps ahead…

They still don't know how to deal with him. Probably won't figure it out until it's way late.

Nineteen black, 43 white, and 15 Hispanic firefighters took the test to become lieutenant; six black, 25 white, and three Hispanic candidates passed. This result counts as discriminatory under the rules of the Equal Employment Opportunity Commission. New Haven was right to worry about the possibility of a lawsuit from black firefighters if it accepted the results of the tests.”
“The city was also in a bind because its agreement with the firefighters union required that the exam count for 60 percent of the decision about whether to promote each candidate and because a city charter rule required that every promotion go to one of the three top-scoring candidates. These rules magnified the disparate racial impact of the exam—no black candidate and only one Hispanic candidate was eligible for promotion, even though several of them passed the test.”

So actually blacks passed the test, but the union contract said that only that those with the top scores could be considered for promotion. The problem was not the test, but the union contract and the city charter.
