I do believe that he came into the presidency with hope for the person that he wants. When you win the presidency one of the first things you dream of is who you can appoint to the High Court. Look what Bush tried to do with his inexperienced female attorney friend. And would have gotten away with it had he not been beholding to that racist vote that put him in.

Latino are an ethnic group, not a race, just like Polish, and Jews and Germans and Irish are ethnic groups and not a race.

Race is a political creation used to divide people. Has nothing really to do with skin color and everything to do with skin color because we've all seen those black real black black black Indians that are just as dark as any Sudanese person but they are not considered black, and we all see black people who are lighter than Kim Kardashian but they are considered black while Kim is considered white. Bridget McCain is darker than many black people but she isn't black, she's Sri Lankan. Irish and Italians were not considered white until WASPS needed them in their group. Arabs are technically Caucasian and there is little genetic difference between many Arabs and Jews.

The Souter replacement can get a previously poor black latina. Another replacement could be a bisexual white single mother. And yet another replacement still could be a disabled black man. Add religion for even more fun options! Shuffle the qualifications any way you like, just like that child's card game that splits a person in 3 and you get a policeman head on a ballerina torso wearing cowboy boots!

Why does identity automatically equal empathy, and why is empathy the primary requirement for Obama's justice? True justice is blind.

If the main goal of judges is to have 'empathy' for the citizens they should become legislators. How the laws we create and enact will effect the daily lives of our citizens is the provenance of the legislature, not the courts. The role of the courts is to weigh cases on the merits of the evidence in accordance with the Constitution, NOT on based status, race, ethnicity, religion or sexuality.

Benjamin Nathan Cardozo (1932-1938) was of Portugese and Jewish descent. That would qualify as Hispanic by definition since his ancestry is from the Roman province of Hispania. I would say he was the first Hispanic to serve on the Supreme Court.

As for Souter “only” breaking on social issues. I didn't quite see it that way, but at the end of the day, the social issues he broke on were important, wouldn't you say?

AAs are the only political entity who does not believe that the POTUS should be held accountable for their vote. Just watch and see how strong the Hispanic lobby puts pressure on the POTUS for the seat. They will probably get it too, because AAs surely wont apply pressure. SAD but true.

And, it's Roe v. Wade the only thing that matters? I mean, S/he could be the most radical corporatist judge on the Planet. Someone who'd never side with the little guy. Or, S/He could be someone who thinks Brown v. Board of ed was wrongfully decided….a racist for all we know…..but just as long as S/he upholds Roe v. Wade? I disagree with that position. I'm really tired of social issues. At this point, economic equality for minorities with the one dominant group is the one thing that TRULY matters. Anything other than that is a distraction in achieving that goal.
