I didn't read the incident report super-carefully (it's 7:30am and I've been up all night) - and people have (probably) already pointed this out - but what those employees could have been responding to is the behavior of the customer, not his/her race. Like people have said - using a re-usable shopping bag while shopping - just stuffing items in your own bag - instead of using a shopping cart - would be inherently suspicious. The "proper" way to use a re-usable shopping bag is at the checkout - you present the bag to the clerk as he/she is getting ready to bag your items (or you bag the items yourself).

That said - on the other hand - race could have played into the equation by the person not being given the benefit-of-the-doubt. These days, customer behavior is supposed to be much more important in determining who is suspicious than race - but a racial bias can make an employee deem a behavior "suspicious" in a black customer that he/she would have seen as harmless in a white customer. It is a complicated issue - and there are lots of "shades of grey". That's why in some ways - it is more challenging being black in 2009 than it was in 1950. Racism is more complex, can be layered or "disguised" underneath so many other factors - and is often denied. It causes a lot of confusion and frustration.

In my own experience - I am "profiled" and "watched" suspiciously all the time in stores - but these days, I don't see it in the stark racial terms that I used to see this behavior. The main reason is that I've noticed that black employees now watch you as much (if not MORE) than white employees (then again, black people have been known to harbor racial prejudices against "their own"). Maybe it depends on where you live - but here in Atlanta, black people have gotten into the "retail loss prevention" game in a big way. I'm just as likely to be watched/followed/offended by a black person as I am a white/other person.

For example - when I first started shopping at Whole Foods, I would have complaints about the (white) employees slyly watching me in the aisles - always seeming to find some reason to be near me as I'm browsing the shelves (you know the old, tired "restocking the shelves" trick). But after awhile, I noticed the plethora of black employees Whole Foods employeed - and started noticing that I would be blatantly stared at by these black employees. These employees weren't staring at me because I'm good-looking (though I wish this was the reason): I picked up on the fact that the staring was an institutional, "silent" way to send the message to "suspicious" customers, "You're being seen. Don't steal." I actually think Whole Foods got clever about the whole loss-prevention thing - and realized if they employeed black employees to watch and "intimidate" black customers, then the whole racial angle would be in large part circumvented.

But it's not only Whole Foods - I notice it everywhere: black employees (or black Loss Prevention employees) watching suspicious customers. So it's not so much a white-on-black, pure "racial profiling" thing anymore. Not to me.

By the way, I'm a perfectly innocent customer who doesn't steal (I never have). I just notice a whole lot, and it isn't pretty. Open your eyes: if you're anything like me, you're being glanced over, stared at, watched, followed, suspected ALL THE TIME. Even the phrase, "May I help you?" doesn't mean what it used to be - these days, "May I help you?" is often Retail-ese for "I'm letting you know I'm here, and that I see you - since you seem suspicious. You better not steal." Or, they may utter, "Did you find what you were looking for?" at odd times: the whole concept of "customer service" has been perverted into a loss-prevention tactic.

OK so this has been happening to me...the funny thing is that I have no reason to steal anything...My husband has a great job working for the courts that he has been on for 21 years...It`s really sad that I have to go into the store with diamonds and prada just tobuy some dam eyeshadow. My sister who works for longs drug told me that this happens often when you do not look the part of having money...sweats, tennis shoes...wow I said what if I was just comming from working out do I really have to put on these fancy clothes to go shopping I have opted not to return to that store...only with my husband as a witness that this is going on..I only went there to get some eyeshadow that was on sale then I hear security scan all areas of the store and this is all the time when I go in there no matter what time of the day the clerk sees me comming thru the door ...then she gets on the phone and calls to the office then I hear security scan all areas...what am I stupid..do they not know that I know whats going on..I dont know what to do on the other hand I want to call my lawyer but my sister is like.. this is what we have to do no matter what the race is...not to be funny but I look at them like you know I make in a month what you make in 6...I`m not saying that I`m better than anyone but this pisses me off...due to the fact that I have money to spend you are judging me on what I look like thats a real shame..To bad I`m not the owner of the store all parties involved would have been fired on the spot

Will writing this up and sending it to the corporate office really help? I ask this question because it appears like that this has been going on for some time and the corporate office is aware and has probably initiated the racial profiling. What I would do is stop spending my hard earned money at places that are doing this racial profiling. By shopping at these places we're keeping the businesses in business and we're allowign them to continue to treat us this way. Change the way youdo things and spend your hard earned dollars at a location that treasts you like all people shoudl be treated.

@ Noelani,

"Anyway, I'm following the rotation and a two sets of black patrons happen to come in on this one guy's rotation. After I seat the second table he storms the host stand, yelling at me like a mad man, accusing me of purposefully seating him with black folks so he wouldn't make any money."

I am not going to lie, there have been times where I have felt I was put in the "Black section" of a restaurant. I have went off on anybody, but I have certainly took note.

The most recent incident was over the summer at a new restaurant here in Hyde Park. Perhaps, it was a simply matter of the rotation schedule. However, it seemed to coincidental that all the Black folks were in the same section.

Sometimes, it is easy to be paranoid.

I'm not sure why this matters from a technical standpoint. Sure, re-usable shopping bags are usually intended to be used at the checkout. But if we believe Jack's friend's description, there was no way he was going to leave the store without being checked for his stuff. An inconvenience to unbag the items, scan them, then bag them up again, maybe--but that's on the cashier and the workers for not speaking up earlier. All those folks passing by and nobody asked him to use a cart or basket? Yo' fault.

Yes CPL, I've been thinking for some time now that the only remedy for this type of behavior (Bell, Grant, the young man shot in his driveway in Texas, the young man shot in front of his mother's home in Louisiana...) is sustained and coordinated civil suits. Since police departments will not police themselves, and municipalities will not provide oversight, the only solution is to seek civil redress in the courts. At some point city and state governments will get tired of shelling out loads of money for brutality cases and begin to provide oversight. This type of stuff happens because no one is ever held accountable. If jobs and pensions were on the line, you'd better believe these "accidental" killings would stop. I'm thinking here of the Southern Poverty Law Center's long term strategy of bankrupting the klan through the courts. Get together a center/team/clearinghouse of lawyers to coordinate responses to these types of incidents on a national level, while pursuing civil cases at the local level.

I doubt if there is a black man in this country that it has not happened to. I skip Asian stores more than any other ones, they are the worst, and, the Arab ones not too much better. The last time it happened to me was a couple of years ago in a supermarket. I was with a white buddy of mine looking at the outside plant section when this big, huge, dimwitted, $7 an hour, white security "guard" was following behind us, not at all trying to hide what he was doing, in my jovial mood, I asked him "how's it going tonight sweetheart?" He looked like the chump he was and left, if I get stalked again as a 50 year old gray headed black man, this will be my response.

You might, but you would be in the minority. Those green bags are used by people ALL THE TIME. It is not a purse, man-bag or plastic bag you picked up outta your kitchen cupboard that we are talking about....it is a very distinguishable green bag usually with a big RECYCLE, or the ones from Whole Foods, written across the damn front. Yeah if somebody is going around putting canned goods, tampons, etc in THEIR PURSE you would be suspicious...but that's not the case at all in this instance. Plain and simple, white people use those damn bags all the times and when they get out of their car there is no antenna that goes up to tell them "I better do x, y and z so the employees dont think I'm stealing"...they just go thru life, LIVING LIFE. The employees dont even clue IN on Ally and Becka when the sliding doors open and they walk in. The racial profiling didn't happen because the employees at this Walgreen's saw his putting objects in a "mysterious" bag that was foreign to them, the racial profiling happened because they saw a black man.

I want to know how that punk officer could just quit and not be forced to answer any questions. He could skip out of the country or anything. I've never seen a cop quit during an investigation. He's just basically announced his guilt.

I'd say that bringing a bag in Trader Joe's is fairly common though because recycling is encouraged. Other situations do require a little finesse though. I think involving the media and your individual's City Administration is very important. Large companies get state and federal funding after all.

I cannot tell you the number of times I've been followed through various drugstores in San Francisco and usually by Asian employees. I always go the manager and I've refused to make purchases if I felt it was necessary. I also write to the corporate office. In Walgreens case they've been sued for profiling Black customers as well as being sued by employees for not promoting Black staff to any other position than store clerk. The last incident occurred in August and the manager at least had the decency to look embarrassed but I let them know I wouldn't be spending my money anywhere I wasn't treated with dignity.

You are so right and I have to apologize to spirit for saying overcompensate because it's so true ... no one should be overcompensating and reward poor service and poor behavior.

My best friend stopped tipping waitstaff that profile her and I should do the same. It's not right at all.

I have another instance of seeing it from the other side.

I worked at this restuarant in the River North area of Chicago some years back and there was this assumption from the wait staff that most of the black patrons came over from Cabrini Green. I don't know why they deduced that, because, although Cabrini Green wasn't far from where I worked, the restuarant was in downtown Chicago and everyone from around the city and suburbs came downtown (that's a no-brainer).

In any case,
There was an assumption by all the servers and hosts that black folks didn't tip and they were the ones more than likely to ditch the bill. I knew deep down that wasn't a universal truth, but my coworkers, white, black, brown and other really BELIEVED it.

When I say this was a multi-cultural staff ... it really was, we had an Indian guy, black woman, gay man, deaf gay man, white folks, rich girls, poor girls, country folks anyone you could imagine worked in that restaurant but they all seemed to hold that same stereotype as fact.

One day, we were really busy and I was hosting, I was following the evening rotation I set up. Anyone who has ever hosted knows what that is ... basically you set up stations for the servers at the start of your shift and rotate the tables that way. So when patrons came in, whomever turn it was to be seated, that's who got table.

Anyway, I'm following the rotation and a two sets of black patrons happen to come in on this one guy's rotation. After I seat the second table he storms the host stand, yelling at me like a mad man, accusing me of purposefully seating him with black folks so he wouldn't make any money.

I was shocked and embarrassed. I couldn't believe he was acting that way ... the most surprising thing was ... that he was black himself.

Go figure.

So that conditioning that Talibah spoke of seems to happen but it's far from right. It's wrong ... period.

That's where profiling goes wrong ... it's really about behavior. Not skin color but people get conditioned for whatever reason to see it as color or race.

Suspicious behavior by ANYONE should be the issue, not just the fact someone is brown or black.
